• Introduction:

We are delighted to have you on Hyyzo! Please carefully review these Terms of Service ("Agreement" or "Terms of Service"), as they constitute the legally binding terms and conditions governing your use of the services provided by Hyyzo (hereinafter referred to as "Hyyzo", "we", "our", or "us"). By registering as a user on Hyyzo, you expressly acknowledge and accept the terms outlined in this Agreement. Please thoroughly peruse and understand these terms prior to using our services.
Hyyzo reserves the exclusive right, at its sole discretion, to amend or modify this Agreement at any time, with such changes taking effect as stated in the “Alteration Of Terms” clause mentioned hereinafter.

• Our Service

We at Hyyzo enable our users to earn cash back on purchases made through retailers listed on our platform. Additionally, we provide discount codes and coupons from various online retailers, enabling our users to maximise their savings.
If you need more information or have any questions about our services, please feel free to contact us. We are committed to providing clear and comprehensive assistance to all our users.

• Account Creation

Hyyzo is designed and developed for use by Indian customers only and provides cashback exclusively in Indian National Rupees (INR). To register for a Hyyzo account, you must be an Indian resident with a minimum age of 16 years. Each eligible individual is permitted to have only one account.
For security reasons, changes to the name and email address associated with your Hyyzo account are not permitted. As a user, you are required to provide accurate, genuine, and up-to-date information during the registration process, including your name, email address, and other relevant details. You are also responsible for keeping this information current in case of any changes.
Since email is the primary means of communication between you and Hyyzo, please ensure that you have full access to the email address provided.

• Account Termination

Hyyzo reserves the right to terminate any account found engaging in fraudulent, abusive, or otherwise unfair activities. Accounts deemed "inactive" may also be subject to termination.
If a user fails to provide a valid or serviceable email address, their membership will be terminated. Hyyzo also retains the right to refuse or deny membership to any individual at its sole discretion.

• Cashback

As a Hyyzo member, you are entitled to earn cashback for purchases made from the retailers listed on our platform. However, cashback will only be credited for genuine transactions that are successfully tracked and verified by the retailer. Once the transaction has been verified, Hyyzo receives a commission from the retailer, which is then passed on to you as cashback.
Please note that in certain situations, your transaction may not be tracked or may not qualify for cashback. Hyyzo cannot be held responsible for any such instances, as retailers determine the validity of a transaction based on their policies. Any transaction deemed non-genuine or invalid by the retailer will not be eligible for cashback.  
Hyyzo will make every effort to recover unpaid or missing cashback from retailers. In the event that a genuine transaction does not result in cashback, you may file a claim by contacting our support team. However, Hyyzo reserves the right to discontinue efforts to recover cashback at its sole discretion, and any such decision will be final and binding.
Please note that "Hyyzo Diamonds" is a term used for reward points/cashback, whose value may fluctuate over time. You can check the current value of these points on our app and website before shopping through Hyyzo.
Occasionally, you may receive a lower cashback amount than expected. This typically occurs when the retailer credits us with a lower commission than initially stated. You are free to raise a query in such cases, and we will follow up with the retailer. However, Hyyzo reserves the right to close the query if the retailer fails to resolve the issue within three months.
Hyyzo reserves the right to forfeit approved cashback under the following circumstances:
- If the user is not logged in while transacting through Hyyzo, and an unattributed cashback payment is received that is not associated with any user account.
- If the cashback is attributed to an account that has been terminated by Hyyzo under any of the clauses mentioned hereinafter or before.

• Referral Bonus

Hyyzo offers a referral bonus in perpetuity. Existing users making successful referrals will receive a Hyyzo Diamond cashback equivalent to 10% of the Hyyzo Diamonds earned by the referred member with each transaction. Only genuine and unique referrals are eligible for this bonus, and the referred member must make their first redemption from their Hyyzo account. Multiple accounts or fraudulent signups by the same user will result in permanent termination of the accounts involved.

• Mode Of Payment

Hyyzo provides four payment methods through which users may request withdrawals:
1. Bank Transfer
2. UPI
3. Mobile Wallet
4. Shopping Vouchers / Gift Certificates / Gift Cards

Users may submit a payment request once they meet the required conditions. Withdrawals of validated cashback are permitted when the user’s account balance meets the following thresholds: a minimum of ₹200 for the first redemption and a minimum of ₹50 for all subsequent redemptions.
If a user chooses to close their account or if their account is closed for any reason before reaching the initial ₹200/₹50 withdrawal limit, no amount shall be payable to the user.
Users are responsible for providing accurate and up-to-date payment information. Hyyzo is not liable for payments made to incorrect accounts or destinations or for any delays in processing payments.
If suspicious or fraudulent activity is detected in a user’s account, Hyyzo reserves the right to indefinitely hold all payment requests pending further investigation or to cancel any cashback accumulated up to that point.

• Privacy Policy

Our Privacy Policy governs the collection, storage, and usage of personal data exclusively through Hyyzo and applies solely to information shared by or collected from visitors to our website and app. The terms of this policy do not extend to any data collected through offline mechanisms or any other means outside this website and the official Hyyzo app. This Policy forms part of this document, and by agreeing to it, you also give us consent to handle your information as per the policy's terms.

• Intellectual Property & Copyright

Hyyzo and all the content therein are protected by the copyright laws of India. All copyrights, trademarks, and intellectual property rights associated with Hyyzo and its services are the exclusive property of Hyyzo. Any unauthorised copying, reproduction, or distribution of any part of this website or the Hyyzo app, including its content, whether modified or unmodified, is strictly prohibited without the prior written consent of Hyyzo. Furthermore, no individual or entity is permitted to commercially exploit Hyyzo's identity, logo, or services in any manner.
By uploading or submitting any material to Hyyzo, you grant Hyyzo a non-exclusive, worldwide right to use, reproduce, and distribute such material. This license applies without any compensation to you and remains effective for the duration of the intellectual property rights in the material.

• Our Role

All transactions you perform on Hyyzo are executed between you and the individual retailers, not Hyyzo. Hyyzo does not participate in, nor is it responsible for, any transactions you carry out on the websites of the retailers listed on our platform. Hyyzo solely acts as an intermediary for referrals, redirecting you to the retailer’s website, and is thus exempt from any liability or legal obligations that may arise in connection with the sale of goods or services by the listed retailers.
Hyyzo disclaims any control or responsibility for the following:
- The quality, safety, or legality of the goods and services offered by retailers listed on Hyyzo.
- The ability or willingness of the retailers to supply the goods and services they advertise.
Any issues or disputes related to such matters must be resolved directly with the respective retailer.

• Unauthorised Or Malicious Use Of The Hyyzo App & Website

Hyyzo reserves the right to suspend or terminate any user account and forfeit any accumulated earnings if the user is found in violation of our Terms of Service. Users are prohibited from making or attempting to make transactions with retailers or earning cashback by providing false or misleading information. Additionally, users must refrain from fraudulently or unfairly exploiting retailer offers.
Any attempts to tamper with the website, including but not limited to URL modification, unauthorised URL distribution, email cloaking, automated scripts, or spying on web pages, will immediately suspend or terminate the user's account.
Furthermore, Hyyzo members are strictly prohibited from posting any material that:
- Is defamatory, offensive, abusive, obscene, indecent, or malicious in nature;
- Contains any form of malware, including but not limited to computer viruses, macro viruses Trojan horses, worms, or any software designed to interfere with, interrupt, or disrupt normal computer operations or to intercept, access without authority, or expropriate any system, data, or personal information;
- Violates any applicable law or regulation;
- Infringes the rights of any individual or entity;
- Advertise goods or services without authorisation.
Users are encouraged to report any content on the Hyyzo platform that violates these terms. Hyyzo retains the right, though is not obligated, to remove any such material found in violation. Users are solely responsible for any legal issues arising from the content they post.

• Liability

Hyyzo's liability is limited strictly to the provisions explicitly stated within this document. Hyyzo shall not be held responsible or liable, whether in contract, tort, or otherwise, for any other obligations, duties, or claims beyond those expressly outlined herein. Furthermore, Hyyzo shall bear no liability towards you or any other individual or entity concerning the material provided by users, transactions (or lack thereof) with retailers, or any actions or communications related to such material or transactions.
Users are solely responsible for maintaining the confidentiality of their account passwords. Hyyzo disclaims any responsibility for the theft or misuse of passwords or any consequences that may arise therefrom.

• Indemnification

You agree to indemnify and hold Hyyzo harmless from any liability, loss, claim, demand, damage, or expense arising from:
- Your use of the Hyyzo app and website;
- Any violation of the terms and conditions mentioned here in this document;
- Any transaction (or attempted transaction) with any retailer listed on Hyyzo.
While Hyyzo diligently cares and implements stringent measures to ensure the accuracy and currency of the information provided on its platform, It does not assume liability for any errors, omissions, or losses arising from the use of such information.

• Alteration Of Terms

Hyyzo reserves the exclusive right to modify the terms and conditions mentioned in this document at any time, at its sole discretion. Upon any such modification, a new version of the Terms of Service will be posted, and users will be duly notified about the changes. The revised terms will take effect within 30 days from the date of notification.

• Miscellaneous

Any instance of failure on our end to act upon any breach of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. If any part of this agreement is held to be invalid, the remainder of this agreement shall remain valid and enforceable.

• Web Links

The Hyyzo app and website may contain links to external websites. We do not assume responsibility for the practices, content, or availability of these external websites. It is recommended that you review the terms of use and privacy policies governing your use of such linked websites. Any concerns regarding the content or functionality of these external sites should be directed to the administrator of the respective website. Hyyzo is not responsible for any outside resource or content existing outside of the Hyyzo app or website.

• Termination of Program

Hyyzo reserves the right to terminate the Program, in whole or in part, at any time with prior notice. In the event of termination, you will have sixty (60) days from the date the notice is sent by Hyyzo to the email or residential address provided in your account during registration to redeem any accumulated Hyyzo cashback. Hyyzo is not liable for any failure to notify you of the Program's termination if such failure is due to an inaccurate email or residential address or the recipient’s failure to check messages promptly.

• Virus Disclaimer

Hyyzo makes every effort to rigorously scrutinise all content posted on the platform. However, we cannot be held responsible for any loss or damage to the data on your computer or device that may occur while using Hyyzo. Users are advised to take necessary precautions to safeguard their systems.

• Legal Jurisdiction

All provisions of this document and the relationship between Hyyzo and its users are governed by the laws of India. Any disputes arising in connection with this agreement shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan

• Keeping this Agreement

Hyyzo will not maintain individual agreements for each user who registers on the platform. This agreement is accessible through our website, and it is recommended that you retain a copy for your records by printing or downloading it to your personal computer or device.

• Assignments

You may not assign, transfer, delegate, or otherwise convey any of your rights, obligations, privileges, or performance under this agreement without the prior written consent of Hyyzo. Participation in the Program is personal to you, and any Hyyzo Cashback earned under the Program may not be assigned, transferred, or conveyed to any third party except with Hyyzo’s express written permission. The sale, transfer, lending, exchange, pooling, or bartering of any Hyyzo Cashback, except by Hyyzo, is strictly prohibited. Any Hyyzo Cashback assigned, sold, or otherwise transferred in violation of this provision may be confiscated or cancelled.
